It was all up to “Baby R” and Mother Nature of course!!!

8:30am Saturday morning (UK time), we were awoken by a phone call from Dr S saying “Congratulations! Your baby has been born and it’s a boy!”. We both bolted out of bed, went into the girls’ bedroom to find two smiling faces peering at us from over the edge of the cot, and we all went downstairs for our traditional group “jelly hug” … where Aunty Brenda found us “grinning like Cheshire Cats”.

Reuben Harvey Alexander ...

Reuben For my father who passed away when I was 10

Harvey For two of Trevor's heros ... We are so much more relaxed this time than last …

We will be arriving back in Melbourne on Monday night, and then it’s going to be another whirlwind of making sure the girls are settled with Aunty Barb who will be moving into our house while we are going, repacking, and then off to the airport once again! I can see the massive amount of jetlag looming on the horizon now! LOL

As many of you may know, my sister Barbara took four week’s leave to come with us when we collected Evelyn and Gaia from India. She is taking more time off to look after them while we will be in India collecting Reuben, and it is with great pleasure that he was born on her birthday. What a birthday present for Aunty Barb! We love you and thank you for all the help and support you have given over the past year and a half. We are BOTH parents ...

With great nervousness and excitement, we had our day in the Family Court recently, where we petitioned for parental orders so that the non-bio-dad (NBD) of Evelyn and Gaia can have the same rights afforded to him as a "normal" couple.

After being shown into a courtroom, the Registrar started by saying that she usually never reads the case notes before a hearing, but for some reason she read ours, and point-blank said that she and the Senior Registrar did not have the powers to grant our request.

She then went on to say that, however, she had managed to find a free court and a judge, who was waiting upstairs "now", and would hear our case!

Trevor and I, lawyer Peter Berry (Berry Family Law) and our Barrister, Susan Buchanan, waited upstairs until the courtroom was ready. We then went in and sat in front of His Hon. Justice Cronan.

His Honor said that he was not sure he could grant our request, but with some assistance from Ms Buchanan, you could see the little light go off in his head, that he could actually grant the orders!

As we went through "the process", you could almost see him ticking off boxes on his list, and after some evidence provided by us on the stand (now THAT was a nerve-wracking experience!) he said something along the lines of ... blah blah blah "Mr Elwell and Mr West - who I will now refer to as 'the parents' ... !!!!!

At that stage I can't exactly remember what went on. I'm sure Trevor has a bruise on his knee from where I was squeezing so hard, and the tears were definitely starting to roll down our faces ...

WE ARE NOW BOTH OFFICIALLY PARENTS!!!!!

Why did we have to do this?

Because we, as a same-sex couple, cannot marry in Australia, we do not automatically get the same rights over children as a heterosexual couple do when they marry. We also cannot adopt, second-parent adopt, or cross-adopt ... so basically, the NBD had NO official rights over the girls. What happened if the bio-dad (BD) was in an accident? The NBD can be refused entry as he is technically not "family", he also cannot sign any paperwork in regard to the welfare and well-being of the girls.

But now ... woo-hoo!!!

Our latest scans ...

We have also just received our 28-weeks scans of "Baby R" ... growing nicely, and still expecting to be delivered the last week of September.

A quick update on the girls ...
Evelyn - three top teeth, three bottom
Gaia - two bottom teeth, and two top teeth (after a few interrupted nights of sleep!)

Gaia can now also sign "more" and "cat" ... clever bunny she is! (no, there are no hearing problems, but we have been using Australian Baby Hands since the girls were newborns as a means of communication).

It's only a couple of weeks until we all fly to the UK so the girls can meet Trevor's relatives - especially his 97yo grandfather (who Skypes and was busy rebuilding his computer last time we spoke to him!).

We are back for a week or so, and then off to India again! (nervous / excited / exhilerated much?!?!)

We are in the process of getting our Indian visas sorted, and the flights are booked, so it really is happening. I do have to admit, I am looking forward to a couple of days in Bali before we land in New Delhi ... am in need of a rest.

A quick update on the girls ...
Evelyn - two bottom teeth, two top, and one top coming through any day
Gaia - two bottom teeth, and one top coming through any day

Both girls are now walking everywhere, and you REALLY do have to have eyes in the back of your head! We now have to be very vigilant with their washing basket, as we have already put one of the Buzz PS3 controllers through the washing machine! LOL (it survived)

Our neighbour Natalie and her hubby Barry bought the girls some GORGEOUS clothes from a local market, under the brand KaT Clothing (I think!). We had been a topic on her blog Mamamia - www.mamamia.com.au - after our bit appeared on 60 Minutes. (You can also see the three-part story here ...)

Both Trevor and I sat back and watched the page after page after page of debate on whether we should have had children, what type of parents would we be, etc etc. Those 'people' I like to call the 'Fringe Christians' trotted out their tired old arguments ... "They need a mother AND a father" ... "Homosexuality is a SIN" ... blah blah yadda yadda ... only to have their views shot down by the many readers of Mamamia who obviously thought that we deserved to have a family as well!

As has happened several times, the RR have dealt that well thought out, Bible-based, "no-one will argue this" argument ... "But they're FAT! How can they look after children if they cannot look after themselves?". This always has us in hysterics ... obviously these people have never visited their local shopping centre, or they need to visit the one in the neighbouring suburb ... THERE ARE FAT PEOPLE WHO HAVE CHILDREN!!!!

We were very touched when Mia herself interjected into the debate, shutting the topic down completely and posting a very sincere and heart-felt apology to the girls, Trevor and myself ... she had never shut down any of her topics before, but she had also never been so disgusted with the personal attacks and vitriol that came our way. Snaps to Mia!!!

Anyway ...

We recently sent her a link about Rebecca Griffin's new book Why Didn't Anyone Tell Me? (info coming soon), she replied saying that she was going to be in Melbourne in the next couple of days, and was very keen to visit us, as she often wondered how we were going with the girls. She also wanted to do a little 'informal video interview' to be posted on her blog. I have reproduced the three-parts here.

Yes ... we are a "Modern Family" ...

We first caught wind of this show just before it premiered in the US. Both Evelyn and Gaia are free-standing and 'cruising' around the furniture ... and Gaia has even started taking those first shaky steps by herself.

Evelyn still only has two teeth, and we are anxiously waiting for Gaia to produce some munchers (insert song ... All I want for my birthday is my two bottom teeth).

Baby R is now at the 16-week stage ... and by all accounts from Dr Shivani, the surrogate is absolutely glowing, and that the pregnancy is progressing very very smoothly indeed.

Here is one of the 12-week scans we received a couple of weeks ago ...

We are getting very excited about the prospect of another set of little feet pattering around the house ... and we really don't care whether it's a boy or a girl ... as long as it's healthy, and has all of it's bit where they are supposed to be!

It's going to be an emotional weekend for me especially. Even though it has been 17 months since Mum passed away, I think about her every day, and the fact that she will not be here (in person anyway!) for the girls' first birthday, will lay heavily on my mind and my heart. I have the special candle that Trevor bought me for Christmas ready and waiting ... and we will have a little private ceremony to light it for both my Mum and Dad, and Trevor's grandmother Dorothy.
<img width='1' height='1' src='https://blogger.googleusercontent.com/tracker/7468710498269999594-7599931100174035996?l=ethicalsurrogacy.blogspot.com' a chat on the bed.

That's when it finally hit me ... we were over 8-weeks pregnant with "Baby R" ... almost at the end of our first trimester! Our second scan arrived last week, and it showed a very healthy pregnancy.

We had decided to use a small hospital for this pregnancy, instead of a clinic. It's nice to know that all the medical procedures are done under one roof, and supervised by the same doctor. Dr Shivani and Phoenix Hospital have been wonderful.

Our first surrogate had not "taken" (so no happy news for Christmas), but transferring less embryos carries this risk; but we were lucky enough to be able to have a second attempt, and we received the news early Feb that our second surrogate had returned a beta test in the high 180's ... a very positive sign!

Our collective fingers are crossed that everything proceeds along nicely ... and Evelyn and Gaia will have a little brother or sister later in the year!

A big week of achievements ...

Wow! What a week it's been!

We had 60 Minutes contact us last Thursday wanting to film a quick "catch up" segment for their first show of the year ... and they wanted to do it that Saturday! That took all afternoon ...

And then the girls decided to come into their own -- Evelyn cut her second tooth, and Gaia discovered the difference between commando- and regular-crawling (She's off and racing now ... time to really baby-proof the house!) Evelyn has also taken her first crawling steps. It's quite interesting to watch; Evelyn sits back and watches Gaia work out how to do things, and then she just goes ahead and does them! Smart cookie ... ;-) Gaia can also pull herself up into a standing position ... big week for all of us!

<img style="cursor:pointer; cursor:hand;width: 240px; height: 320px;" src="http://3.bp.blogspot.com/_0PBFxwwqCmc/S48VQE2lf8I/AAAAAAAAAJA/I69v4dNkwzc/s320/evelyn_teeth.jpg" border="0" alt=""id="BLOGGER_PHOTO_ID_5444593840439001026" />

Evelyn showing off her new teeth ...

<embed src="http://www.youtube.com/get_player" type="application/x-shockwave-flash"width="320" height="266" bgcolor="#FFFFFF"flashvars="flvurl=http://v4.nonxt4.googlevideo.com/videoplayback?id%3D995a9ee02c796175%26itag%3D5%26app%3Dblogger%26ip%3D0.0.0.0%26ipbits%3D0%26expire%3D1329891435%26sparams%3Did,itag,ip,ipbits,expire%26signature%3D4A59F09B2B531885C3300D7F9E761EFF5110F55D.8014A0E9E49A6C28F61114CC0FD4D43C12E3D3FD%26key%3Dck1&iurl=http://video.google.com/ThumbnailServer2?app%3Dblogger%26contentid%3D995a9ee02c796175%26offsetms%3D5000%26itag%3Dw160%26sigh%3DyqBDysA3Qg9ntOzZFvsfh0AdKtE&autoplay=0&ps=blogger"allowFullScreen="true" />

Gaia on the move ...

The 60 Minutes segment is going to air tonight, and the nerves are starting to kick in a little. A friend of ous had agreed to be the egg donor, and her half-Pakistani parentage would have fit right in with our desire for a Hispanic/Mediterranen donor.

We were arranging a trip overseas anway, as we had planned to celebrate Trevor's 40th birthday with a group of friends in Bali, so we added a trip to Mumbai before we went to England and onto Bali.

Okay ... first lesson learnt ... make sure you have a visa!!!!! We were two-thirds of our way to India, when we realised that our travel agent had not organised a visa, and Qantas in Sydney had let us on the plane without one!

So ... after a 13-hour flight from Sydney to Mumbai, the immigration desk wanted us to get straight back on the plane back to Sydney! Luckily, the pilot said the plane was full and he was about to take off ... so the lovely Qantas staff in Mumbai argued that we should be allowed to continue onto our next stop ... London!

Fate steps in when she has to. It was fortuitous that we missed our step in India, and had to move onto London, as Trevor got to spend two more weeks with his grandmother, who unfortunately passed away not long afterwards.

Luckily we were able to rearrange our flights so that we could go back to Mumbai, before we travelled onto Bali to celebrate Trevor's 40th birthday.

We arranged an appointment at the clinic, and got to meet the senior staff and check out the facilities. We made our bookings, paid our deposits ... and arrange for me to return approx. six weeks later to meet our egg donor. As I would be leaving fresh samples when I returned to Mumbai, Trevor also had to leave a "small desposit" of his own!

It was while shopping at a local market not long after our first appointment, that we got the news that Trevor's grandmother had passed away ... talk about a day of mixed emotions! The fact that she passed while we were starting our own "circle of life" certainly did not go unnoticed!

As we did not have as much time in India as we originally intended, we had to leave a couple of days later to continue onto Bali.

Where to start ...

I guess the easiest way to start is to start at the very beginning! (No references to Maria please ... LOL)

Trevor and I met almost five years ago, and it was very early on in our relationship that the topic of children was raised. I have got four older sisters, and have been brought up among young children and babies for most of my life. Trevor always wanted children, and had been asked to donate sperm in the past, but the option of actually raising children had not crossed his mind. It wasn't until I said that I wanted to HAVE a family, that his little light went "Bing!", and he started looking into how we could have children of our own.

Adoption was not an option much to our disappointment, as we cannot get married in Australia (yet!), and "single men" are not allowed to adopt! We did not want to "part-time" parent with another couple, nor be foster parents ... this did not leave us with many options!

We made some enquiries with a couple of the American surrogacy agencies; the price was daunting, but we could have run to it ... just ...

We arranged to have a discussions with one American agency EARLY one Saturday morning (it was still Friday afternoon there!). After three hours of talks, the agency dropped into the conversation that "you will also need to pay for the egg donor's medications and travels, plus the medical expenses of the surrogate mother ... probably another US$70,000"!!! These additional costs put us out of the ballpark ...

After some more internet research, Trevor stumbled across a clinc in Mumbai that would work with same-sex male parents. The idea of using an Indian egg donor was okay with us, as we had been looking at Latino/Mediterranean egg donors anyway ... a little bit of skin colour would be good for the Australian sun!

We contacted the clinic ... and the process started from there ...
